Ownership and scope
The websites delstudio.store and delstudio.site (the "Websites") are owned by Eduard Varariu Diaconu, operating under the trade name DEL Studio.
Unless expressly indicated otherwise, the original contents of the Websites (texts, designs, logos, images, videos, documents, structure, and code) are protected by intellectual and industrial property rights. Their ownership corresponds to DEL Studio or its respective owner. Publishing content does not imply the assignment of rights nor the granting of a general licence for use.
Software, developments and professional services
The rights to the software, source code, tools, templates, and documentation of each project are governed by the corresponding contract and Work Order. Unless agreed otherwise:
- Developments created specifically for the client are assigned to them once their price has been paid in full.
- The tools, components, methodologies, and reusable materials of DEL Studio prior to or independent of the project remain the property of DEL Studio, and the client receives a licence of use for the deliverables.
Hiring a service does not in itself imply the transmission of all intellectual property rights. This Notice does not alter the rights corresponding to the client or third parties by law or by contract.
Permitted and prohibited uses
You may access the Websites and consult their contents for legitimate personal or professional purposes. You may quote fragments for the purposes of commentary or criticism, indicating the source and the author, in accordance with Article 32 of the Recast Text of the Intellectual Property Law (Ley de Propiedad Intelectual).
Unless there is written authorisation, a specific licence, or a rule that permits it, it is not allowed to:
- Reproduce, distribute, or publicly communicate the contents in a substantial manner.
- Modify, adapt, translate, or create derivative works from the protected materials.
- Commercialise, resell, sub-licence, or exploit the contents.
- Remove authorship notices, trademarks, indications of ownership, or protection mechanisms.
- Present contents, designs, or developments of DEL Studio as your own.
- Use its trademarks, logos, or distinctive signs in a way that generates confusion regarding ownership, affiliation, or sponsorship.
These limitations are understood without prejudice to the exceptions and limits recognised by law.
Automated extraction and text and data mining
It is not permitted to extract the contents of the Websites in a massive or systematic way through scraping, robots, crawlers, or other automated means without prior, express, and written authorisation.
In accordance with Article 4 of Directive (EU) 2019/790 and its transposing regulations, DEL Studio expressly reserves the reproduction and extraction rights necessary for text and data mining on the contents of the Websites, including the collection of datasets for the training, fine-tuning, or evaluation of artificial intelligence or machine learning systems. The fact that contents are publicly accessible does not imply authorisation for those uses. This reservation is complemented, where technically possible, with machine-readable instructions, such as those in the robots.txt file.
Trademarks and distinctive signs
The trade names, logos, and trademarks appearing on the Websites belong to their owners. Their appearance does not imply a commercial relationship, sponsorship, association, or approval, unless expressly indicated. The use of DEL Studio's distinctive signs in a way that infringes rights, misleads, or suggests a non-existent relationship is not authorised.
Third-party content and components
The Websites may include contents, libraries, software components (including open source), typefaces, images, videos, or services from third parties, subject to their own licences and conditions. DEL Studio does not claim ownership of them and respects the licences applicable to them. In professional projects, the incorporated third-party components are detailed in the documentation or in the contract.
Notification of possible infringements
If you consider that any content on the Websites violates your intellectual or industrial property rights, please write to hello@delstudio.site and indicate:
- Your identification and a means of contact.
- The work, trademark, or right that you consider infringed and, where appropriate, the documentation proving your ownership or your authority to act on behalf of the owner.
- The URL or exact location of the questioned content.
- An explanation of the alleged infringement.
Do not include personal or confidential data that are not necessary. We will review the communication and adopt the measures that correspond according to the circumstances and the law. Receiving it does not imply that an infringement exists, and it does not limit your right to seek judicial recourse.
Unauthorised use
If materials over which DEL Studio holds rights are used without authorisation, we may request their removal or the cessation of that use and exercise the actions legally available. Nothing in this Notice limits the rights, defences, or remedies that the law recognises for users and third parties.
Relationship with other documents, updates and language
This Notice complements the Legal Notice, the Terms of Use, and the Acceptable Use Policy. For deliverables and professional service materials, the contract and the Work Order shall prevail, without prejudice to mandatory rules.
We may update it when the Websites, services, or regulations change; the current version indicates its date. It is offered in Spanish, which shall prevail if translations are published, unless a mandatory rule states otherwise. For enquiries regarding intellectual property, write to hello@delstudio.site.
